The State of Utah limits local jurisdictions’ ability to enforce nightly rental proscriptions. Park City bans nightly rentals in many single-family neighborhoods because of the possibilities of disturbance and activities that are not conducive to the family neighborhoods. Utah prohibits cities from enforcing those local ordinances solely on the basis of advertising through various means, so they must enforce on the basis of complaints and failure to license according to city ordinance.
The City denies nightly rental licenses in zones where they are prohibited. Some people continue to advertise and rent in violation of the law. The city sends out mailed notices of infraction. If homeowners continue to violate nightly rental ordinances, the city issues a citation with fines from $100-$200/day. If those fines are not paid, the city then liens the property.
